Civic Groups Support NYSERDA Board’s Request For External Review of SUNY Poly Land-Swap
We join the Authorities Budget Office in strongly supporting New York State Energy Research and Development Authority board members who called for an “external review” of the transfer of the Saratoga Technology + Energy Park to SUNY Polytechnic for $1 at their September 21 board meeting.
We applaud the NYSERDA board members for fulfilling their responsibility under state law to meet their fiduciary duty and to act with a “Duty of loyalty and care to the organization and commitment to the authority’s mission and the public interest.”
We agree with the public remarks of the Authorities Budget Office that the NYSERDA board was doing exactly what independent authority members in New York are expected to do in calling for such an external review.
Under state law, NYSERDA is an independent state authority governed by an independent board of directors who are responsible for the authority’s spending.
